The Nineth Commandment and Related Scriptures:

PRINCIPLES OF LIBERTY

Foundation of Due Process:

Our God ordained Divine Rights, Civil Rights, and Human Rights.

..1 RIGHT TO INTELLECTUAL FREEDOM:
While Paganism and Idolatry must be stopped (see Commandment #2), and blasphemy or associated profanity against God prohibited (see Commandment #3), and violent rebellion or revolution suppressed (see Commandment #5), and sexual immorality restrained (see Commandment #7), (and heresies rooted out of Our Congregations--see Heresies under Commandment #3), the Hebrew Traditon of diversities of opinions must be tolerated and Our Subjects allowed to hold, speak, and publish their various opinions and views--and especially so, if there is some intellectual or scientific basis for such thinking (Acts 5:34-39). Consequently, the Right to Dissent or disagree with the majority or respected (official) view is Sacred and must be tolerated (for all too often, what was popularly held to be wrong or incorrect by the establishment, turns out to be true or scientifically sound, later on)!

Moreover, herein, we must also recognize the God given Power to Mankind of Free Will and the Right to contemplate evil or think on the supposed pleasures and consequences of wicked ways, balancing them in our own minds as to determine our own courses of action! (Joshua 24:15) For, we must all struggle and learn to overcome temptations (1 Corinthians 10:13).

..2 RIGHT TO PRIVACY (Search and Seizure)
with protection from unreasonable search and seizure--where the accusation or charge is required and given (so that there is reasonable cause for the search), the item(s) being sought specifically named along with the places to be searched (no general searches), and the search being done in the presence of the accused or his witnesses (so there can be no planting of evidence), with as little disruption of things (and a return to normal, afterwards) as is possible (Genesis 31:30-37, 44:4-12). Moreover, this Freedom provides coverage from common peeping toms or snoops as well as more official mail readings or phone (computer) taps. (See LAW-9.E.2.c COMMON POLICE LIMITATIONS under Due Process, or LAW-10.C.5 NATIONAL POLICE, and LAW-10.D.4 THRONE GUARD under Conspiracies. Also, for privacy issues (Deuteronomy 25:11-12 & 29:29; 1 Samuel 6:19).

..3 RIGHT TO PROTECTION FROM POLICE BRUTALITY, HARASSMENT, OPPRESSIVE INTERROGATION, OR TORTURE:
for Our Realm is NOT to be a Totalitarian Society nor a Police State, but rather one where Law Enforcement is held in its proper place by Godly checks and balances (Acts 22:24-29). (See also LAW-9.E.2 Search and Seiizure, above, and LAW-10.C. HIGH CRIMES under Conspiracies.)

..4 RIGHT TO PROTECTION FROM MOB VIOLENCE OR VIGILANTI ACTION:
for Our Courts are open and if anyone has a grievance against another let them pursue it through proper channels and by Due Process (Acts 21:31-36). See also, LAW-9.B.6 VIGILANTI ACTION in previous Article, above.

..5 RIGHT TO TRIAL (Hearing):
where the formal and full accusations and charges are presented to the accused (Acts 25:27), with the opportunity given him of defending his actions--before any punishment is meted out (John 7:51 and Acts 25:16), and within a reasonable amount of time to avoid unjust incarceration (Ezra 7:26).

..6 RIGHT TO ADVOCACY AND COUNSEL:
the accused should have the liberty of collecting information and witnesses in his defense (Exodus 22:11; Deuteronomy 22:15; Psalms 59:1; Acts 23:16-22, 24:23), with the Right to Compel or Supeona vital witness to attend his Trial, as well as the Right to Counsel to help him organize his case--even for the poor and needy--(Exodus 18:16, Deuteronomy 6:7-9), and the Right to Advocacy to speak in his defense--especially for the disabled or infirmed--(John 14:16-17, 26; I John 2:1).

..7 RIGHT TO A FAIR TRIAL:
where proper judicial procedures are followed and the correct Due Process of Law observed (Matthew 18:15-17; Acts 23:1-3).

..8 RIGHT TO CROSS-EXAMINATION:
the accused has the Right to know his accusers, to confront them in Court, and examin their testimony to be sure that it is not purjury (Deuteronomy 19:17-18 and Acts 25:16).

..9 RIGHT TO A JUST AND UNBIASED JUDGEMENT:
the accused has the Right to a judicial decision based on the Laws of God and the evidence presented in his case--free from bias, prejudice, or sentiments (or undue influences) that might pre-dispose him to be condemned unjustly (Deuteronomy 16:18-20). Nor shall the accused's judgement be based on the past record of his Family (Ezekiel 18:1-29).

..10 RIGHT TO A PUNISHMENT THAT FITS THE CRIME:
if the accused is found gulty, he is to receive a sentence that fits the crime(s) that he has committed (Exodus 21:23-25), with cruel and unusual punishment, or torture, strictly forbidden (Deuteronomy 25:2-3).

..11 RIGHT TO MERCY:
The administration of Justice is not automatic nor run by a machine, but rather by men who are to have a feeling heart, even as God does (and yields to compassion). Consequently, anyone who pleads guilty and makes an appeal for mercy MUST be given some measure of leniency (Numbers 14:19; Nehemiah 9:19; Proverbs 20:28; Matthew 5:7), even in Capital Cases (Ezekiel 18:23, 32, 33:11; II Peter 3:9). For Our LAW must have a HEART!

..12 RIGHT TO APPEAL:
If the accused believes that he has not gotten justice, he may appeal to a higher Court or authority to have his case corrected (Acts 25:10-12). However, breeches of proper procedure do not necessarily dismiss a case, but rather certainly establish punishment for those who pursued error (and open the door for a lessening of the sentence, depending on the seriousness of the breech)!

..13 RIGHT TO PARDON:
Despite the sound conviction of guilt, the accused still has the Right to request a pardon from the appropriate authorities in his case (Exodus 34:9; II Chronicles 30:18-19; Nehemiah 9:17; Psalms 25:11; Isaiah 55:11).

..14 RIGHT TO VISITATION:
Finally, even while incarcerated, the accused or convict is entitled to visitation by his family and friends (and counsel)--to ensure that he is not being abused or tortured (Acts 23:16-22, 24:23, 28:30-31)
